2022 Rezoning & Preliminary Development Plan

On May 12, 2022, the Council approved a request to make changes to Fenton's zoning. The changes included creating a second development option for the primary anchor store, providing additional flexibility for signage, and making other minor revisions to the zoning's Preliminary Development Plan (PDP). The first option (which was previously approved and remains in effect) for the primary anchor store area included the following:

Other changes that were approved as part of this rezoning included:

  • Increasing the maximum height of the building(s) in Pod 3.
  • Removing the minimum building height requirement for the retail jewel box buildings (Pods 17-21, 31, 32, 34 and 36).
  • Allowing Medical Office uses wherever Commercial or Office Uses are allowed, with clarification that Medical Office uses may not be located in the one-story retail jewel boxes.
  • Providing clarification and additional flexibility regarding the types and location of signage throughout the development.
  • Revising the art commitment at the site’s Cary Towne Blvd entrance to be fulfilled by the Trinity Road Artwalk.
