Case: 23-REZ-01 Alston Yards (O'Kelly Chapel/NC 55 Mixed Use)
Location: West of the intersection of O'Kelly Chapel Rd and NC 55 Hwy
Description: Rezone 46.29 acres to Mixed Use (MXD) to facilitate a mixed use development inclusive of vertical components near a retail core totaling up to 400,000 square feet (SF) of office, 815 multi-family dwellings, 200 hotel rooms, 55,000 SF of commercial, and either 180 hotel rooms or 180 residential condos. Additionally, 30,000 SF of community gathering areas and 1700 linear feet of greenway trails.

Case: 23-REZ-03 The Courtyards at White Oak
Location: Between Batchelor and Yates Store Rd
Description: The applicant proposes rezoning an assemblage of four properties located south of Pine Rail Lane and east of Knotty Oaks Drive totaling approximately 71.66 acres, which includes a request for Cary to apply initial Town of Cary zoning to approximately 50.60 acres currently zoned Residential-40 Watershed (R-40W) in Wake County, and to consider an amendment to Cary’s Official Zoning Map for approximately 21.06 acres zoned Residential-40 Conditional Use (R-40-CU), for zoning of Transitional Residential Conditional Use (TR-CU). All properties within the zoning request will be subject to the Watershed Protection Overlay (Jordan Lake subdistrict) and the Conservation Residential Overlay District (CROD).

Case: 23-REZ-04 Wheatsbury Drive Rezoning
Location: 106, 108, 110, 112, and 114 Wheatsbury Drive
Description: Rezone five properties located in the Stonegate Subdivision by changing the conditions for the existing Residential-8 Conditional Use (R8-CU) zone that were placed on the lots during the original 1993 zoning approval. The owners of these properties seek to remove several zoning conditions, including one that required a fence to remain behind the lots. The applicants are also proposing one condition with the new rezoning that uses be limited to single family detached dwellings and accessory uses. All applicable Cary Land Development Ordinances would continue to apply.

Case: 23-REZ-05 South Hills Development
Location: Forty-four acres along Buck Jones Road (location of the South Hills Mall site) near the intersection of Walnut Street, North of US Hwy 1 and West of I-40.
Description: The property owner is seeking to redevelop the property as a vertically integrated, mixed-use development offering a connected framework of residential, office, and retail space with the option for a community center within the development.
Cary is concurrently in the conceptual planning phase for a community and sports recreation facility which could be located within the development. The concept design phase should take approximately one year to complete including public engagement.

Case: 23-REZ-06 Woodfield Walnut PDP
Location: 9.19 acres at the intersection of Macedonia Road and Jones Franklin Road Description: Cary received an application to rezone 9.19 acres at the intersection of Macedonia Road and Jones Franklin Road from General Commercial (GC) and Residential-40 (R-40) to Mixed Use District (MXD) with a Preliminary Development Plan (PDP). The applicants wish to rezone to allow for the development of a multi-family development with up to 330 units. The rezoning proposal includes a commitment to a minimum of 12,000 square feet of community gathering area, ten electric vehicle charging stations, a variety of architectural conditions, and structured parking. The Watershed Protection Overlay (Swift Creek subdistrict) and Mixed Use Overlay Districts will remain.

Description: Cary received an application to rezone a portion of property located at 2001 Kildaire Farm Rd from General Commercial Conditional Use (GC-CU) to Mixed Use District (MXD). The existing Mixed Use Overlay District (MUOD) and Watershed Protection Overlay (Swift Creek Subdistrict) will remain. The rezoning would allow a portion of the site to redevelop up to 750 residential units and 30,000 commercial square feet with building heights of 4 to 7 stories.

Description: Cary received an application to rezone 23.57 acres south of the intersection of Morrisville Carpenter Road and Saunders Grove Lane from Residental-40 (R-40) to Residential-8 Conditional Use (R-8-CU). The applicants wish to rezone the subject property to allow for the development of detached residential, neighborhood recreation, and/or park and open space uses. Additional zoning conditions limit development of the site to no more than 52 dwelling units, provide a streetscape ranging from 50 to 60 feet in width, and commit to construction of a greenway along the western side of the property
